2. VALIDITY

This page contains the terms and conditions (hereinafter named as the "Terms") that apply to the agreement between the visitor or customer (hereafter designated as "You") and GMM FESTIVAL bv – LIVE NATION (hereinafter named as "we" or "GMM") and relating to all orders, operations, deliveries, services
and offers between these two parties in the context of this online shop.


By ordering one of the products from GMM through the online platform, you agree to these Terms and Conditions. The moment you pass an order on the GMM webshop, you confirm that you have read these terms and conditions and agree with them.

GMM guarantees that the product meets the contract, product features and product photos in the offer. Certain product features, such as color, size, and others may differ with delivery from the product photos, as shown on the website. This is usually indicated in the product description, but if you are not satisfied,
please contact us to find a solution.


These Terms and Conditions, as well as any information on the site are the intellectual property of GMM and are copyrighted. It is not allowed to use products, product photos and/or text from the website for commercial purposes unless permission has been given by GMM. Any infringement may result in legal
actions.


3. DELIVERY AND SHIPPING COSTS

Standard shipping with BPOST: € 7,50, € 16 or €20 depending on what country we need to ship too (EU countries). We will ship within 10 business days unless otherwise indicated on the website.

We will do our best to make sure the products are delivered at the delivery address you provided with your order and within the delivery period specified by us. The standard delivery takes 5 to 10 working days (Saturday, Sunday and holidays not included), starting on the day when you have placed your order and at the time we receive your payment, unless otherwise indicated. If you choose to pay by bank transfer, we will send your order after we receive your payment.


If your order cannot be delivered on time, we will inform you as soon as possible. 


All our products are sent with BPOST. On delivery, you may be asked to sign a receipt.
If an order cannot be delivered because of an incorrect address provided by you or if you are absent at the time of delivery, BPOST takes further contact with you. BPOST may also deliver your order at the neighbors, unless specified otherwise in your address.


If an order is not delivered within the specified delivery time, an investigation is started with BPOST. This may take several days and a refund or replacement shipment can only be executed after this investigation.

Shipping costs are standard fixed at €7,50 or €15 for EU countries. Delivery to other countries can sometimes entail higher shipping. In these cases, ROCK WERCHTER will contact you to reach an agreement. We reserve the right to change the amount of the shipping costs at any time, but will always inform you whether you agree to this.


4. PRICES

All prices are expressed in euros and include 21% VAT. Shipping costs are not included in the prices of the products and are clearly communicated.


5. PAYMENT

You can choose from the following payment options: Bancontact or Creditcard. Payments are secured with SSL encryption so that every online payment is safely passed. If payment is not received immediately (e.g. by bank transfer), GMM uses a 7 day deadline for the payment after receiving the order. If we do not
get the payment after 2 reminders and those 7 days, your order will be canceled automatically. Your order will be sent once GMM has received the full payment amount. GMM is in no way responsible for any credit card fraud or identity theft of their respective holder.


6. RIGHT OF WITHDRAWAL

You have the right to withdraw your purchase within 14 days, without having to have a valid reason. Please contact us and we help you as soon as possible.

We can credit your refund or create an exchange order to send the right size or a different model. 

If you have not found a satisfactory resolution to your dispute by contacting us, we commit to trying to reach a solution through a qualified consumer dispute resolution entity. In our case, the competent entity is GMM Festival BV – Zandbergen 104, 2480 Dessel - Belgium - BE 0811.589.003 - merchandise@graspop.be

We also draw your attention to the existence of the European Union's "Online Dispute Resolution" platform. If you wish to submit your request online, you can file an application for out-of-court dispute resolution via http://ec.europa.eu/odr. This platform facilitates the online resolution of the dispute and connects you with the competent qualified entity. This route is particularly beneficial when you do not reside in the same country as the business involved (including linguistic support). National contact points can assist you with this process. To return an item, you have two periods of 14 days each.

The first 14-day period starts the day after delivery. Within this initial 14-day period, you must inform us that you wish to withdraw from the contract/purchase. It is best to do this via email, as a reply to your order confirmation. Alternatively, you can notify us by phone if you prefer.

Once you have informed us that you wish to withdraw from the purchase/return an item, a new 14-day period begins during which you must actually return the item to us. It is sufficient to send the item within this period; it is not required for us to receive the item within this period. You must, however, be able to prove that you have sent the item.

The return shipping costs will be covered by us. GMM Festival BV / Graspop will generally provide a return label for this purpose. In other circumstances, the method of return shipping will be discussed and agreed upon mutually. Nevertheless, GMM Festival BV will bear the cost.

Additionally, the shipping costs from the original order will be reimbursed by us. This applies only if no new (or replacement) order is shipped.

We, GMM Festival BV, will always process your refund within 14 days from the day we were informed of your decision to withdraw from the purchase/return the item.

 

7. WARRANTY AND COMPLAINTS

GMM Festival BV guarantees that the Graspop products meet the agreement, as stated on the website in the product description or product image.

If this is not the case, and the products show signs of a defect, please notify us within 2 months after the defect was discovered.  Any form of compensation can never exceed the amount that was billed to you. Normal wear or (un) intentional changes to the product are covered by the guarantee.

You can contact our customer service as indicated on top of our Terms and Conditions. We do our best to handle your complaint or request as soon as possible. Please provide us with as much information as possible regarding your complaint so we can handle it as quickly as possible. This information is at least the order number and your full name, but can also be photos of the product and a detailed description of the defect or complaint.

The return shipping costs will be covered by us. GMM Festival BV / Graspop will generally provide a return label for this purpose. In other circumstances, the method of return shipping will be discussed and agreed upon mutually. Nevertheless, GMM Festival BV will bear the cost.

8. FORCE MAJEURE

GMM cannot be held liable for non-compliance with the agreement due to force majeure. Force majeure means any strange reason or circumstance that reasonably ought not to come to its risks: e.g. sickness, negligence by suppliers and / or manufacturers of GMM, strikes, government measures, disruption of the
Internet, electricity or programs and delays with our suppliers.


9. LIABILITY

This module takes precedence over all other terms and explains our full liability. GMM is liable according to the legal obligations for defects or losses caused by negligence. Nothing in these Terms and Conditions can hold us liable for fraud, death or personal injury caused by a breach of our obligations or any other
liability which cannot be excluded or limited by applicable law or your legal rights as a customer.


10. DATA

When you place an order on the website of GMM, your data will be collected and processed by GMM as described in our Privacy Notice. The transmission of incorrect or false identity information is considered a breach of these Terms and Conditions.


11. APPLICABLE LAW

All our agreements and offers are subject to Belgian law. Any dispute relating to or resulting from the offers or agreements concluded with GMM, are under the jurisdiction of the territorial court, unless this is in conflict with international rules on consumer protection.
